What arrives at the port, and which rules matter most?
Ocean containers
Ocean cargo needs an Importer Security Filing (ISF) no later than 24 hours before loading at the foreign port (19 CFR 149.2). The port 4601 page lists a contact for ISF holds. See ISF filing.
Vehicles
Cars arrive in containers and on Ro-Ro vessels. Each vehicle needs DOT Form HS-7 and EPA Form 3520-1 with the entry. A vehicle 25 years old or older, to the month, is exempt from the DOT standards (49 CFR 591.5(i)). Section 232 duties can apply. See vehicle import.
Food and consumer goods
FDA needs prior notice for food no less than 8 hours before the vessel arrives (21 CFR 1.279). FDA can also examine or sample goods at the terminal or at an exam station.
Air cargo at Newark
The CBP port page lists an air cargo contact for port 4601. FDA lists express facility codes 4670 (UPS Newark) and 4671 (FedEx at Newark Airport). Air cargo needs no ISF, and general order starts on day 15 after landing (19 CFR 122.50).
What goes wrong at port 4601, and what should I do?
Demurrage and detention charges
The terminal charges demurrage after the free time, and the carrier charges detention for a late empty return. Under FMC rules, an invoice must show the free time, the dates and the rate (46 CFR 541.6). You have at least 30 calendar days to ask for mitigation or a refund (46 CFR 541.8). CBP orders an intensive exam
The container moves to a centralized examination station (CES), a private facility where CBP officers examine goods (19 CFR 118.1). The importer pays to prepare the goods for exam (19 CFR 151.6) and the CES fees (19 CFR 118.4). Terminal free time can end while the exam is open.
ISF or manifest hold
A late or incorrect ISF can stop the container and can bring liquidated damages against the bond. Correct the ISF first. Then write to the port group mailbox, as the port asks.
Wood packaging without the mark
Pallets and crates must carry the treatment mark. If the mark is missing, CBP can order the immediate re-export of the wood packaging (7 CFR 319.40-3(b)(3)). Ask the supplier for marked wood before shipment.
No entry by day 15
The carrier must report unentered cargo to CBP no later than 20 calendar days after landing, and the cargo then goes to a general order warehouse (19 CFR 4.37). Storage there is at your risk and expense.
Cargo moves inland in-bond
Cargo can leave the terminal in-bond for an inland port. It must arrive within 30 days (19 CFR 18.1(i)). See in-bond moves.

How do I import a car through the Port of New York/Newark?
Ship the car in a container or on a Ro-Ro vessel. File the ISF before loading. File the entry with DOT Form HS-7 and EPA Form 3520-1, and pay the duty. Read how to import a car.
How long can a container stay at the terminal without an entry?
CBP allows the cargo to stay at the place of unlading until the 15th calendar day after landing (19 CFR 4.37). Then it goes to a general order warehouse. The terminal free time for demurrage is set by the terminal and is usually shorter.
Can I dispute a demurrage invoice from a carrier?
Yes. The FMC rule in 46 CFR part 541 lists the information that each invoice must show. If required information is missing, you do not have to pay the charge (46 CFR 541.5). You have at least 30 calendar days from the invoice date to ask for mitigation, a refund or a waiver.
Can wildlife products enter through Newark?
Not as a rule. Newark is not a designated port for wildlife (50 CFR 14.12). Wildlife goes through a designated port such as New York, New York, unless the U.S. Fish and Wildlife Service issues a permit for a nondesignated port.
