CBP Form 29: Notice of Action

CBP Form 29 is the Notice of Action. CBP sends it when it proposes, or has made, a change to your entry, such as a higher duty rate or value. There is no blank form to download.

CBP Form 29

What is CBP Form 29?

CBP Form 29 is the Notice of Action. It tells the importer that CBP proposes a change to the entry, or has made one.

CBP uses Form 29 when the entered rate or value is too low, or the quantity is more than entered. The added duty must be over $15 (19 CFR 152.2).

A CF-29 often follows a CF-28. It can also come on its own.

Who and when

Who needs it and when?

  • CBP sends it to the importer of record or its broker.
  • Read whether the action is proposed or taken. A proposed action is your chance to respond before CBP liquidates.
  • CBP liquidates promptly. 19 CFR 152.2 lets CBP withhold liquidation no more than 20 days from the mailing of the notice, unless there are compelling reasons.

Roles

Who signs it and who files it?

  • CBP issues and signs the notice. You do not file a CF-29.
  • You, or your broker, answer a proposed action in writing, with facts and documents.
  • If CBP liquidates with the change, contest it with a protest within 180 days of liquidation (19 CFR 174.12). See CBP Form 19.

Avoid delays

What mistakes delay it?

  • No reply to a proposed action

    CBP can liquidate at the higher rate or value. You then need a protest, which takes longer.
  • A reply without evidence

    State the facts and the legal basis. Send rulings, technical data or cost records that support your position.
  • The same issue on other entries

    A change often applies to other open entries of the same goods. Check them, and consider corrections or a prior disclosure.
  • Counting the protest time from the notice

    The 180 days run from liquidation, not from the date of the CF-29.

CBP Form 29 is not on CBP's public forms page. CBP issues it for a specific entry. The rule is in 19 CFR 152.2.

Can I still dispute a taken action?

Yes. After liquidation, file a protest on CBP Form 19 or in ACE within 180 days.

Does a CF-29 mean a penalty?

Not by itself. It changes the duty on the entry. Penalties are a separate process, for example under 19 U.S.C. 1592.

What will a CF-29 cost me?

The difference in duty and fees on the entries CBP changes, plus interest. We check the math on the notice.

Should I correct my other entries?

Yes, if the same issue applies. Your broker can file post-summary corrections on entries that have not liquidated.
