Power of Attorney (Customs POA)
A customs power of attorney (POA) authorizes a licensed customs broker to transact customs business for an importer. CBP Form 5291 can be used for it.
What does Power of Attorney (Customs POA) mean?
CBP Form 5291 may be used for a customs power of attorney. Another format is valid if it is a general POA with unlimited authority, or a limited POA as explicit as Form 5291 (19 CFR 141.32).
A broker must have a valid POA before it transacts customs business in the client's name. The broker keeps the POA in its records and does not file it with CBP (19 CFR 141.46).
A POA from a partnership is limited to 2 years. Other POAs can be granted for an unlimited period (19 CFR 141.34). A POA from a nonresident has extra requirements (19 CFR 141.36).
The broker keeps a POA until it is revoked (19 CFR 111.23). After that, it keeps it for 5 years after revocation or after the client becomes inactive, whichever is later.
