Country of Origin
The country of origin is the country where an article was manufactured, produced or grown. It decides the duty rate, the additional duties and the marking.
What does Country of Origin mean?
CBP defines the country of origin as the country of manufacture, production or growth of a foreign article. Work in a second country changes the origin only if it causes a substantial transformation (19 CFR 134.1(b)). For a good of a USMCA country, the rules in 19 CFR part 102 decide the country of origin for marking.
Unless the law excepts it, every foreign article or its container must show the English name of its country of origin (19 CFR 134.11). The marking must be as legible, indelible and permanent as the article permits.
The origin often decides the additional duties. For example, heading 9903.88.01 applies to products of China, and each AD/CVD order names a country. Steel and aluminum entries also report the country of melt and pour or of smelt and cast.
What does it mean for your shipment?
Send us the supplier's origin evidence, not only the country on the invoice. Transit through a third country does not change the origin by itself.
