What did CBP announce?
CBP announced that effective September 25, 2026, AESTIR Commodity Filing Response Code 802 changed from Verify to Fatal. Export filings (EEI) that exceed the BIS license shipping tolerance are now rejected until the filer corrects the license data. The change was made at the request of the Bureau of Industry and Security.
What is Allied's position?
This notice concerns Automated Export System (AES) filings tied to Bureau of Industry and Security export licenses, not the import entries we file for clients. If a client also files export declarations under a BIS license, they should check their license data for keying errors to avoid rejected filings. Import clients do not need to take any action on this notice.

What does the CBP message say?
At the request of the Bureau of Industry and Security (BIS), Customs and Border Protection (CBP) will set AESTIR Commodity Response Code 802 to Fatal on September 25, 2026. The code is currently set to Verify. Once set to Fatal, the EEI will be rejected; the EEI must be corrected for the submission to be accepted.

Reason: The License Code/License Exemption Code indicates a BIS license claim. The license value reported on the CL1 record exceeds 110% of the BIS license value. BIS shipping tolerance limit has been exceeded by a prior transaction or the current transaction. Review other alerts issued for further information.
Resolution: The BIS license has been decremented. Verify your proprietary export records and BIS license documentation to ensure no keying errors have been made.
